If you think about the video with the story, you are looking up quite a 
bit when it shows the man standing at his front window.  And there are 
branches of bushes blocking part of the view and which would be blocking 
it more so if the camera was more to the left or right.
So, you had to be standing at a particular spot and looking up quite 
sharply to see the "offending portions" of his anatomy.
If it really went to court, I'd love to be his lawyer and cross examine 
her about how she came to be looking up and through the shrubs to notice 
all this detail and make judgments about his motives.
I think the phrase "Peeping Thomisina" from an earlier post seems very 
accurate based on what the video shows us.   \
Maybe her son saw her stopping and looking and asked "what are you 
looking at, Mom?"   Then she felt compelled to redeem herself.  :<)
