I was only half serious when I suggested fair use...however, I 
believe that at least in the world of the arts, fair use arguments 
have worked even when there is a commercial interest involved (e.g. 
porn "parodies" of mainstream movies; the GONE WITH THE WIND parody, 
THE WIND DONE GONE).
As for Black Bear, they seem to have generated an enormous amount of 
publicity over this.  If I were them, I'd sign some sort of 
settlement with Starbucks, stop using the name Charbucks but admit no 
wrongdoing (if possible), and then remarket the coffee as "Law Suit 
Blend," with a short slightly expurgated version of the story of the 
suit on the label.
